Appointment of State Chief Information Commissioner in the State Information Commission
The Government of Gujarat has constituted a body under the Right to Information Act, 2005 (known as the State Information Commission) to exercise the powers conferred on and to perform the functions assigned to it under the Act. It is located in Gandhinagar. The Commission shall have the State Chief Information Commissioner and such sumber of State Information Commissioners not exceeding tem, as may be deemed necessary. The present composition of the State Information Commission is nocified vide post. in GAD Notification No GS/21/2020/VHS/2014/363RT1 CELL dated 28-7-2020 which can be seen at
hartdaniaratgin. The powers and functions of an Information Commission in the State Information Commissions are as per Chapter V of the Act
2. It is proposed to appoint State Chief Information Commissioner in the Commission. The Act provides that the State Chief Information Commissioner shall be a person of eminence in public life with wide knowledge and experience in law, science and technology, social service. management, journalism, mass-media or administration and governance.
3. The State Chief Information Commissioner shall bold office for a term of three years from the date on which he enters upon his office or till be attains the age of 65 years, whichever is earlier. As per RTI Act, Term of Office, Salaries, Allowances and Other Terms and Conditions of Service of the State Chief Information Commissioner shall be same as provided in "The Right to Information (Amendment) Act, 2019 and "The Right to Information (Term of Office, Salaries, Allowances and Other Terms and Conditions of Service of Chief Information Commissioner. Information Commissioners in the Central Information Commission, State Chief Information Commissioner and State Information Commissioners in the State Information Commission) Rules, 2019.7

Further, the State Chief Information Commissioner shall not be a Member of Parliament or Member of the Legislature of any State or Union Territory, as the case inay be, or hold any other office of profit or connected with any political party or carrying on any business or pursuing any It is clarified that cessation termination of holding of office of profit, pursuing any profession or carrying any business is a condition precedent to the appointment of a person as State Chief Information Commissioner.
